we recently hired a worker for our construction company, he refused to sign any papers down to the point of we have no proof that he worked for us. well he now has told us that he is not going to work for us anymore and he went and underbid one of our jobs, and is now doing that job. he has no licenses and he knew what we bid. is there anything we can do?

Why would you want to do anything... most likely the person will lose their butt on that job and most likely a few more after that and then you won't have to worry about them anymore.
Then - shame on you for not documenting proof of employment. What about paychecks?
If you really want to get the person you could call the state authorities or if you see something unsafe give OSHA a quick tip.

i tried to document proff of employment but he refused to sign the paperwork so how do i document in that situation ? oh and thankyou for your reply. i really do thankyou for your help.

How did you pay him? If you wrote him a check that was cashed - that should be proof enough.

yes I payed him by check. but how can we stop him from doing this again? we have 3 more jobs that he knows the bid on

Talk to the owners of the project. Being up front and straight with them is your best course of action. Say something like you're looking out for their best interests in telling them. Don't make it look like your pulling Mom's shirt tails to tattle. Just be honest.
Hopefully you really low balled your bid and he'll bid under you :) be less time waiting for him to disappear.

lol yes I guess you're right about that. we cut the bid really close just to get the job to show them that we do quality work, to maybe have some word of mouth advertisement. He will lose on this job I know that much. We have only been in business for a mont and a half. So this job was really imprtant to us. But there will be other jobs.

Oh.. new start-up. Although it doesn't change the way I feel about it - it does make getting the job a little more important.. and would probably push me into going to the owners and conversing with them.

I called her today, She said that she was just going to do it herself, and I explained everything to her and I was very honest, But then my husband rode by the job and sure enough there the other guy was.

so at that point I just did not know what to do. I'm used to dealing with ironworkers !! lol

My husband is so mad I'm just afraid he will want to go back to ironworking. I would rather have the business and him safe.
