View Full Version : wanting to pull off 3/10 of 3.299 acres

:?: There is a piece of property that was left to 10 heirs. One heir wants her portion plus the two portions she bought. Now she owns 3/10.
This piece of property is pie shape, we are allowing her 40 foot road frontage, how many feet should we go up for her 3/10.
We know the front is 40 feet.
Not to good in math, wanted to find out, surveying would be an expense.

I'm not good in geometry. In most areas you'll need a new survey done in order for the deed transfer. Should be around $300 for the survey.

You are talking about approximately 13,000 square feet of property. With 40 feet of frontage, your pie shaped piece of property will be approximately 653 feet deep. Be sure to have a proper survey (with pins installed) done before the subdivision is recorded - although many municipalities will require an official survey anyway.

Boy, this could be dicey. To give you an example: up here in Canada ( in Ontario anyways) we have property that we call condo's where you actually own one unit. Whether it is one apartment or one town house etc etc. We also have co operatives which look exactly like the condo but you don't own a whole piece of anything. If you live in a 20 unit group then you would in fact own one twentieth of each unit but would live in one though you actually owned only one twentieth of it.
Now back to the property in question.. This owner may in fact own three tenths of the whole thing not in fact three separate pieces. Until the 10 owners actually divide the land into pieces it will be like a corporation which owns something.

I watched my dad and his 3 sisters take over 20 years to settle my grandfather's estate.

And they all got along.

I told him that I didn't care if he left me anything, but if he wanted to he had better make sure it was mine.
