The dispute with our builder has been resolved, and we are satisfied with the outcome. We withdraw all complaints against them.

As more and more time goes on, I'm convinced that the values of America are rotting like month-old lettuce. One of the primary causes is big corporations. This is a perfect example. They claim that they exist to serve the customer, but most only give a damn about making as much money as possible. $2500 to install Tyvek which should be on every house anyway... Extra money for low-e windows? Geesh. $3000 for cellulose insulation? Cripes.

Fidelity sucks. I notified them two months ago that they were displaying incorrect earnings for Symantec because of a stock split. They said they would correct it right away. Never got fixed.

Went to US Bank today to try to get a home equity loan to pay my income taxes. Said they wouldn't give me a home equity loan because it wasn't finished. Never mind the fact that I'm a customer. Never mind the fact I only wanted about 40% equity out. Never mind the fact that I walked across the street to the hometown bank, and will probably be approved tomorrow...

I know that this has nothing to do with construction, but this topic reminded me of how much I'm starting to loathe our sick version of a capitalistic republic. Don't forget, America is not a democracy...

Sorry for the rant, I feel a tiny bit better now.

Good luck on the law suit.

I cannot believe how horrible that is. I am sorry you are having to go through this, get a very good lawyer and sue them straight out of business.

Prior to closing the deal did you do a walk-through and create a punch list? If the things that you found were not repaired to your satisfaction, then why would you close?

Law tip: when you get to the point of mediation or court where you are asking for damages, you state: "XXX, plus attorney's fees". If they put the burden on you to take them to court because they refused to fix what should have been fixed, they are responsible for attorneys as well.

I'm currently in the middle of a lawsuit. I started the process in Jan of 2004, and hopefully it will finally make it to court in April if we don't settle in mediation first. It is a long and frustrating process...
