We are building a home on an empty lot. The home is facing a line of trees facing the main road. Perpendicular to this main road is a private road on the left side of the house (facing the front of the house). We would like to use this road in order to get to our lot to build. The owner of this private road is asking for a fee to use his private road. The fee is 2,500 dollars plus repaving it after we have completed building. On top of this fee will be a yearly maintenance fee of about 500 dollars a year in order to create a driveway off of this private road rather than off of the main state road. What should we do in a situation like this? It is only a $25 dollar permit to get a driveway off the main road, however, the issue here is the cost of chopping down trees that are providing priceless value and privacy to the house. Is it true that a house on a private road has better value than a house off a state road?

How large a lot? Do you have room to put in a curved driveway away from the trees you want to save.

This could be a good opportunity to get some advice from someone that can walk the site.

Being off a public road is better than using someone's private road with a repair cost and then an annual fee - The will be never-ending problems and you would need to have an attorney draw up an agreement for you.
