View Full Version : restrictions on my easment?

i recently bought a home and i have a second parcel of land in the back that has an easment on it. there was a shed on it already but i'm not sure what the restrictions are on it. i want to build a new shed on the other side of my yard but still on the parcel of land that has the easment. i noticed there is possibly a water catch back there for the surrounding development and possibly why theres an easment on it, so they have access to it if needed. but before i build a new shed i want to make sure its ok. i looked through my paperwork and couldn't see anything that i understood for why theres an easment. can i call the city and ask them? any helpful info would be great. i live in central mass, thanks

I'd start with the deed. between that and the map in the package from the title insurance co., there should be the info you need. There may also be CC&R's that would be in there. Here, for example, shed needs to be same type of material as main house and same colors.
But calling planning office is good practice, I think. You'll need and could check on setbacks, max size, type of restrictions, etc then.

Either the subdivision map that shows your lots, or your survey map, should show both the extent of the easement, and the purpose of it. No matter what the purpose is, you won't be permitted to place a shed within the easement.

I wouldn't mess with the easement because the house has the right to the shortest route possible. If you're going to reroute the easement, I'd stay away from that idea. If it doesn't interfere, just check the building laws and you should be ok
